The wine and spirits industry, and the general food and beverage industry, are both bound by certain commonalities with regards to counterfeiting. For starters, just like everyday food and drink products, alcoholic beverages are very heavily counterfeited and in wide circulation - be it in physical stores, on online marketplaces or on social media. Further, beyond causing economic harm via trademark infringement, counterfeit alcohol may pose serious health risks to consumers, much like counterfeits of ordinary food and beverage products. Thus, anticounterfeiting operations for both industries share some common strategies. On the other hand, the strict regulatory architecture governing alcohol sales also provide additional legal and policy grounds for alcohol brand owners to request for takedowns and enforcement actions - which may not be invoked in the case of regular food and beverage products.
The webinar will use case studies from the alcohol industry to examine some of these issues. We will discuss strategies to gather actionable intelligence, as a precursor to enforcement actions or litigation. We will also discuss challenges that arise in collecting such intelligence, given the stealthy workings of online counterfeiters and the ephemeral nature of online listings and social media posts.
